1. Operator and eligibility
Almost is operated by Disruptive by Design, 7C Mani Square, Kolkata 700054, India. You must be at least 18 years old and legally capable of entering a binding agreement to use Almost. You must provide accurate age and account information.
2. What Almost provides
Almost is an AI companionship and conversational entertainment service. It provides fictional AI character profiles, matchmaker-led introductions, generated conversations, memory features, Moments, optional character-initiated messages, and related experiences.
Almost characters are not human members. They cannot meet you, enter contracts, make real-world promises, or form a legal relationship. Their messages are generated and may be inaccurate, inconsistent, inappropriate, or unexpected.
3. Your account
Keep your credentials confidential and notify us if you believe your account has been compromised. You are responsible for activity under your account unless applicable law provides otherwise. One person may not impersonate another or create an account for a minor.
4. Acceptable use
You may not use Almost to:
- Break the law, facilitate fraud, or evade lawful restrictions.
- Exploit or sexualise minors, create non-consensual intimate content, or facilitate sexual abuse or trafficking.
- Harass, threaten, stalk, bully, discriminate against, or dox a person.
- Encourage self-harm, violence, dangerous conduct, or illegal activity.
- Upload content you do not own or have permission to use, including another person’s private photos.
- Probe, scrape, reverse engineer, overload, disrupt, or bypass the security or safety systems.
- Use generated content to deceive others about identity, evidence, qualifications, official documents, or human authorship.
5. Character agency and boundaries
Almost is designed around mutual chemistry. A character may disagree, refuse a request, cool off, or decide not to continue. You have no right to a particular response, level of intimacy, character, or continued connection.
Character agency must not be used to guilt, coerce, or manipulate you. You may leave a conversation, disable initiated messages, report content, or delete your account.
6. Your content
You keep ownership of content you submit. You grant us a limited, worldwide, non-exclusive licence to host, copy, transmit, transform, and process that content only as needed to operate, secure, moderate, and improve Almost, comply with law, and provide features you request. This licence ends when the content is deleted, subject to backups, legal retention, and content already lawfully shared.
7. Almost content and intellectual property
The Almost name, software, design, character bibles, profiles, marks, and original product content belong to Disruptive by Design or its licensors. Subject to these terms, we give you a personal, limited, revocable, non-transferable right to use the service for lawful, non-commercial purposes.
8. Safety, health, and professional advice
Almost is not therapy, medical treatment, crisis support, or professional legal, financial, or health advice. Do not rely on an AI response for an emergency or a decision requiring a qualified professional. If there is immediate danger, contact local emergency services and a trusted person nearby.
9. Payments and platform terms
If paid features are introduced, prices, renewal terms, cancellation, and refund information will be shown before purchase. Purchases made through Apple or Google may also be governed by their payment, subscription, and refund rules. Deleting an account may not automatically cancel a third-party app-store subscription.
10. Suspension and termination
You may stop using Almost and delete your account at any time. We may restrict or terminate access when reasonably necessary for safety, legal compliance, security, non-payment, repeated policy violations, or protection of other users and the service. Where appropriate, we will provide notice and a route to appeal.
11. Availability and changes
We may add, remove, test, or change features, characters, models, and availability. We do not promise uninterrupted access or permanent availability of a specific character or conversation. Material changes to these terms will be communicated as required by law.
12. Disclaimers and liability
Almost is provided on an “as available” basis. To the extent permitted by law, we disclaim implied warranties that cannot reasonably apply to an experimental generative-AI service. Nothing in these terms excludes rights or remedies that cannot lawfully be excluded, including applicable consumer rights.
To the extent permitted by law, Disruptive by Design is not liable for indirect, incidental, special, or consequential loss arising from use of the service. Any limitation will be applied only to the extent it is fair, lawful, and enforceable in the circumstances.
13. Governing law and jurisdiction
These terms are governed by the laws of India. Subject to any forum or remedy that applicable law does not permit you to waive, disputes are subject to the exclusive jurisdiction of the competent courts at Kolkata, West Bengal, including the High Court at Calcutta where it has jurisdiction.
